Ads on TV, radio and in newspapers would have you believe that bad credit is no problem. They promise quick, easy financing even if you've had a bankruptcy! It's enough to make you believe that good credit isn't that important anymore. But don't be fooled.

For example: Let's say a person with good credit qualifies for a five-year car loan for $17,000 with an APR of 8%. Here's what he or she will actually pay for the car:

                                        - Amount Financed $17,000
                                        - Interest paid in 5 years at 8% $5,000
                                        - Total price of the loan $22,000

But that same person with bad credit or no credit will pay a higher price because of the greater risk involved for the lender. For our example, we'll say triple the original rate of 8%--that equals 24%.

                                        - Amount Financed $17,000
                                        - Interest paid in 5 years at 24% $17,000
                                        - Total price of the loan $34,000

In this comparison, good credit will save the borrower $12,000 in five years!

If you think a $12,000 difference is huge, think about the difference good credit can make in your mortgage payment. An article in the Los Angeles Times warned home buyers that "A poor credit rating can wind up costing a borrower an extra $418 per month on a $300,000 loan. That's $5,016 a year or $150,446 over the course of a 30-year loan."

Legal credit restoration:
Of all of the processes and procedures available today, by far the most successful way to restore your credit is by having an attorney write precisely worded demand letters on your behalf to each of the three national credit reporting agencies based on your rights under the Fair Credit Reporting Act (FCRA), as amended by the Fair and Accurate Credit Transactions Act of 2003 (FACTA). This Act was established by Congress and allows you to dispute inaccurate and outdated information on your credit reports.

Can you do it yourself? Sure, but the success rate of "do-it-yourselfers" is around 15%. And many do more damage than good to their own credit. Compare that with the over 90% success rate of attorneys who "specialize" in legal credit report correction.

Because of the Fair Credit Reporting Act, you have the right in Section 6:11, to ask for anything to be verified on your credit reports.

Here's how to make it work:
Over a period of time, normally around 12 months, our attorney writes demand letters on your behalf asking each credit bureau to verify negative credit information. There may be one or even several inaccurate and outdated pieces of information in just one listing. These letters are properly worded and sent out at the proper times.

You're hoping that the credit bureaus will conduct an investigation based on the letter our attorney sent them. The letter first goes to a person at the credit bureau called a checker. The only job these people have each day is to open letters and make a determination if they need to do an investigation for that person, throw the letter away, or send out a return letter to the effect, "We find your request frivolous, therefore we have determined that we do not have to investigate."

The whole idea is to get past the checker first. That's why you need an attorney to write the letters properly. If it's not written correctly, it's not going to get past the checkers. If you can get them to do an investigation you're half way there! Generally, one of three things will now happen:

(1) First, since it is easier for them to delete the information than for them to research and investigate it, the negative item may simply be deleted, because an investigation takes up their time and costs them money. Remember, the credit bureaus are for profit companies. They want to make money, not waste it.

(2) The second possibility is that the credit bureau is not able to verify your negative information within the time allowed by law, which is 30 days. They have 30 days to verify and prove that it is accurate, according to the Fair Credit Reporting Act, or they must delete it.

(3) Third, you are also counting on creditors to purge negative information they have about you. For instance, how long do you think a credit card company is going to hold that negative information about you? Some companies retain information for 6 months, some 1-year, some 18 months and some companies, like American Express keep it forever. In most cases, people who filed bankruptcy are the first to be purged because companies don't think they will be heard from again. Sometimes it's cheaper to delete something old to make room for something new.

The result:
Let's say you have a very negative item with inaccuracies on your report, for example a credit card charge-off. A date is wrong, or an amount is incorrect, something is not right. Our attorney writes a letter on your behalf to the credit reporting agencies. They decide to do a credit investigation, and then a postcard goes to the credit card company. A postcard goes back to the credit bureaus saying, "Cannot Verify." SUCCESS! The item will be deleted from your credit report.

Every time a credit bureau does an investigation they have to send you an investigation results letter to show you what happened in the dispute. Your goal is to have your credit bureaus show - THIS RECORD HAS BEEN DELETED.

Caution:
The process may sound easy, however, the credit bureau investigators are highly trained and can trap you into such things as verifying that a negative item is real, and you have done all their work for them. The right attorney will have an understanding of what the Fair Credit Reporting Act is. If your attorney doesn't, find one qualified to represent you.

If you have been through bankruptcy, getting your bankruptcy off of your credit report takes time, because The Fair Credit Reporting Act was amended recently and it gives lenders the ability to verify all bankruptcies by contacting one of the lenders on your credit report that shows that they were included in that bankruptcy.

The whole thing is this: make the credit bureaus do their job. Never call the credit bureaus on the telephone. Always communicate with credit bureaus by letter through an attorney.

Lawful Notices:
In the final step of the process, our credit restoration team provides a service unique to this industry. Our attorneys prepare and send "Lawful Notices" to the creditors via Certified Mail. These are letters of demand requiring the creditors to provide physical proof that you are in fact obligated to this account or the track record matches what has been recorded by the Credit Repositories.

The creditors have approximately 30 days to comply and if they don't, which a large percentage do not, we then inform the Credit Repositories and they are required to remove this negative item. Once again, SUCCESS!

Credit Bureaus and Credit Scores
There may be several small credit reporting businesses in your area, but there are three major credit bureaus that they all report to:

                                        Experian
                                        Equifax
                                        Transunion

What the credit bureaus do
Basically, they are information brokers. The “Big Three" Collect data from thousands of sources. They maintain credit files on everyone who has ever purchased anything on credit. They then sell purchasing and payment history information to just about anyone who wants to buy it. This is a lot of information to process properly.

The credit bureaus are governed by law
The Fair Credit Reporting Act (FCRA) is the federal law that governs how credit information is collected, distributed, reported and corrected in case of errors. You are entitled to a free copy of the law from any Federal Trade Commission office.

The potential for errors
Let’s see, 3 credit reporting agencies, employing thousands of data entry clerks, entering billions (yes Billions) of items of credit data, personal data as well as public record information. You don’t need to be a mathematician to figure out the staggering potential for errors.

In fact, according to recent government surveys: 80-85% OF ALL CREDIT REPORTS ARE INCORRECT!

It’s TRUE!  Reports that are used to determine what we will pay for a mortgage, whether we can get insurance, buy a car, acquire credit cards or even if we are hired for a new job, are full of damaging errors and we are penalized for their mistakes.

Credit Scores
Credit scores, also referred to as FICO scores are based on the information in your credit report. Over the last twenty years, increasingly sophisticated models have been developed to calculate scores. These models have been built using a sampling of many consumers to determine which areas of the credit report are most indicative of credit risk. Entering the information from your credit report into these models produces your credit score. There are many types of models used currently for ‘credit’ scores, as well as other models for such areas as ‘insurance’ scores. All scores, however, are based on the information in your credit report, and reflect similar degrees of risk.

Credit scores were designed for convenience. Many lending institutions no longer look over your entire credit report, they merely place your score within their pre-determined ranges to see in which credit-risk profile you likely fit. In this fast-paced age with an overabundance of information, filtering and screening that information is essential to make timely decisions. Credit score models filter the information on your credit report and produce one number, which those institutions that have pulled your credit report look to first. For this reason, the utmost care should be taken to ensure an optimized score.
